User Agreement of KinoFoxMedia

1. General Provisions

1.1. This User Agreement (the “Agreement”) is a legally binding document that governs the use of the KinoFoxMedia website and related services (the “Service”).

1.2. By using the Service, the user (the “User”) confirms full and unconditional acceptance of this Agreement. If the User does not agree, the User must immediately stop using the Service.

1.3. The Service administration may establish additional rules/terms for specific features (for example, subscriptions, paid access, user accounts). Such rules are considered part of this Agreement.

2. Disclaimer of Liability

2.1. The Service is provided “AS IS.” The administration makes no warranties, express or implied, including warranties of availability, security, fitness for a particular purpose, or meeting the User’s expectations.

2.2. The administration is not liable for:

  • any losses or damages (including loss of profit, data, reputation, or any direct/indirect damages) arising from use of, or inability to use, the Service;
  • actions or inaction of third parties, including internet providers, hosting providers, payment processors, and other external services;
  • the content, legality, quality, accuracy, or reliability of any materials, links, or information accessed through the Service or posted by Users;
  • technical failures, errors, delays, interruptions, temporary unavailability, data loss, or other disruptions of the Service.

2.3. All risks related to using the Service are borne entirely by the User.

3. Restrictions and Rules of Use

3.1. The User agrees to independently assess the legality of their actions and comply with all applicable laws while using the Service.

3.2. The User is prohibited from using the Service for any activity that violates applicable law, including (but not limited to): distributing prohibited content, attempting unauthorized access, interfering with Service operation, exploiting vulnerabilities, spamming, or fraud.

3.3. The User agrees:

  • not to take actions that disrupt the Service or create excessive load;
  • not to bypass access restrictions or attempt to access other users’ accounts;
  • not to use automated tools (scripts/bots) without permission if they affect stability or security.

3.4. The administration may, at any time, without notice and without stating reasons:

  • restrict or block the User’s access to the Service (temporarily or permanently);
  • remove or restrict access to any information/materials;
  • suspend or terminate the Service in whole or in part;
  • change functionality, design, and usage rules.

4. Privacy

4.1. The administration may collect a minimal amount of technical data necessary to operate, secure, and improve the Service (for example, IP address, device/browser data, cookies/sessions).

4.2. The administration does not guarantee complete security or anonymity of data transmitted over the internet and warns that transmission always involves risks.

4.3. Detailed data processing terms may be described in a separate document — the Privacy Policy of KinoFoxMedia.

5. Changes to This Agreement

5.1. The administration may change this Agreement at any time unilaterally, without prior notice.

5.2. Continued use of the Service after changes are published means the User accepts the updated Agreement.

6. Governing Law

6.1. All matters and disputes related to the Service are governed by the laws and jurisdiction determined by the administration.

6.2. If a dispute cannot be resolved out of court, it shall be handled by a competent authority/court under the rules of the selected jurisdiction.

7. Payments and Refund Policy

7.1. If the Service provides digital goods and/or intangible services (for example, subscriptions, feature access, digital content), the User understands that once access is provided, refunds and exchanges are generally not available.

7.2. A refund may be considered only if:

  • the service was not provided due to technical reasons on the Service’s side; or
  • access to the digital good/service was not actually granted to the User.

7.3. To request a refund, the User must contact Support within 24 hours of payment and provide verification details (for example, order/payment reference, date/time, contact information).

7.4. Refund decisions are made by the administration on a case-by-case basis. The administration may request additional information to verify the circumstances.

8. Acceptance of Terms

By starting to use the Service (including registering, signing in, purchasing a subscription, making a payment, or using any site features), the User confirms that they have read and unconditionally accept this Agreement, even if the User did not read it in full.
